Regulation on the Center for Information Environment Research under the Ministry of Culture,

Information, Sports and Youth Policy of the Kyrgyz Republic

Chapter 1. General Provisions

  1. The Center for Information Environment Research under the Ministry of Culture, Information, Sports and Youth Policy of the Kyrgyz Republic (hereinafter referred to as the Center) is a subordinate institution of the Ministry of Culture, Information, Sports and Youth Policy of the Kyrgyz Republic (hereinafter referred to as the Ministry), which monitors the Internet and mass media for compliance with the laws of the Kyrgyz Republic in the field of information.
  2. The Center operates in accordance with the Constitution and laws of the Kyrgyz Republic, other regulatory legal acts of the Kyrgyz Republic, international treaties that have entered into force in accordance with the law and to which the Kyrgyz Republic is a party, as well as this Regulation.
  3. The Center is a legal entity in the organizational and legal form of an institution, has an independent balance sheet and budget, settlement and other accounts in banks and other financial institutions, a seal and letterheads with the State Emblem of the Kyrgyz Republic, and other stamps and letterheads with its name in the state, official, and English languages.
  4. State property is assigned to it under the right of operational management.
  5. The Center is financed from the republican budget and other sources of financing not prohibited by the legislation of the Kyrgyz Republic.
  6. The Center is entitled to enter into civil legal relations in its own name, to act as a party in civil legal relations within the framework of the legislation of the Kyrgyz Republic, and to be a plaintiff and defendant in court.
  7. The official name of the Center is:
  • in the state language: “Кыргыз Республикасынын Маданият, маалымат, спорт жана жаштар саясаты министрлигине караштуу Маалыматтык чөйрөнү изилдөө борбору”;
  • in the official language: “Center for Information Environment Research under the Ministry of Culture, Information, Sports and Youth Policy of the Kyrgyz Republic”;
  • in English: “Center for Information Environment Research under the Ministry of Culture, Information, Sports and Youth Policy of the Kyrgyz Republic.”

The abbreviated name of the Center is:

  • in the state language: “МЧИБ”;
  • in the official language: “ЦИИС”;
  • in English: “CIER.”

Chapter 2. Objectives of the Center

  1. The objective of the Center is to ensure and strengthen information security in the Kyrgyz Republic.

Chapter 3. Tasks of the Center

  1. The tasks of the Center are:
  1. Systematic monitoring of information materials on the Internet and in the mass media containing public calls for violent changes to the constitutional order, violations of the territorial integrity, and sovereignty of the Kyrgyz Republic, incitement of social, national, racial, and religious hatred, as well as other actions aimed at undermining the state system, including information promoting war, violence, pornography, cruelty, terrorism, and religious extremism, as well as information on the methods of creating, producing, and obtaining narcotics, psychotropic substances, and their precursors.
  2. Analyzing the compliance of the content of materials distributed on the Internet and in the mass media with the requirements of the legislation of the Kyrgyz Republic, aimed at ensuring the protection of the interests of individuals, society, and the state in the information sphere, and preventing destructive negative information-psychological impacts on the public consciousness.
  3. Preparing proposals for creating conditions for the development of the national information market by identifying problems hindering the effective functioning of domestic mass media.
  4. Preparing and issuing conclusions based on the results of monitoring the Internet and mass media regarding identified violations of the legislation of the Kyrgyz Republic in the field of information.
  5. Ensuring interaction with government authorities, public associations, and international organizations, including the administrations of popular social networks, on issues of information security.
  6. Improving the system for monitoring the Internet and mass media.
  7. Developing proposals for improving legislation and regulatory frameworks in the information sphere, enhancing the material and technical base of mass media, and preparing qualified personnel, taking into account foreign experience, modern requirements, and standards.

Chapter 4. Functions of the Center

  1. In order to fulfill its tasks, the Center performs the following functions:
  1. Conducting monitoring of information materials on the Internet and in mass media;
  2. Developing recommendations to improve the information environment in the Kyrgyz Republic;
  3. Collaborating with expert and advisory communities in the information sphere;
  4. Analyzing and identifying conflict zones in the Internet space, as well as problematic situations related to information issues;
  5. Collaborating with experts and consultants to stabilize and harmonize the information situation in the country;
  6. Developing regulatory acts in the sphere of Internet relations regulation;
  7. Preparing and conducting comprehensive examinations of the content of information materials for compliance with the legislation of the Kyrgyz Republic aimed at protecting the interests of individuals, society, and the state;
  8. Identifying intentional or unintentional actions of mass media that have a destructive influence and cause harm to the physical or mental health of citizens;
  9. Preparing and presenting to relevant government authorities conclusions about the activities of mass communication entities, along with recommendations for correcting identified shortcomings and violations;
  10. Organizing training, retraining, and professional development for the Center’s employees, and participating in seminars and conferences on the development and functioning of mass communication means;
  11. Improving the activities of the Center by applying modern work organization methods, introducing new technologies based on foreign experience in monitoring mass communication means;
  12. Interacting with government authorities, public associations, and other organizations on issues within the competence of the Center;
  13. Carrying out other functions provided by the legislation of the Kyrgyz Republic in the information sphere.

Chapter 5. Rights, Duties, and Responsibilities

  1. To perform its functions, the Center, within its competence, has the right to:
  1. Determine the main directions of its research, analytical, and other activities in the established order;
  2. Have access to the electronic reporting system and monitoring data archives;
  3. Develop and implement projects and programs in the field of information;
  4. Develop direct relationships with other government bodies, public organizations, civil society institutions, and the expert community, as well as international organizations and donor institutions;
  5. Enter into contracts and agreements with legal entities, individuals, and international organizations in accordance with the legislation of the Kyrgyz Republic, and engage experts and consultants from the Kyrgyz Republic or, if necessary, from abroad for activities related to the Center;
  6. Publish periodicals and series, form databases, hold scientific conferences and other scientific-practical events;
  7. Engage in other activities not prohibited by the legislation of the Kyrgyz Republic.
  8. The Center is obligated to:
  1. Operate in accordance with the legislation of the Kyrgyz Republic;
  2. Ensure the objectivity and reliability of the research and analysis of the information situation;
  3. Adhere to the established procedure and deadlines for work;
  4. Ensure the required level of competence among specialists performing analysis and monitoring work;
  5. Be accountable for its decisions and activities.
  6. The employees of the Center are responsible for violations of regulatory legal acts in accordance with the legislation of the Kyrgyz Republic.

Chapter 6. Organization of the Center’s Activities

  1. The Ministry coordinates and controls the activities of the Center.
  2. The Center submits reports on its activities to the Ministry and the Cabinet of Ministers of the Kyrgyz Republic.
  3. The Center is headed by a Director, appointed and dismissed by the Chairperson of the Cabinet of Ministers of the Kyrgyz Republic upon the proposal of the Minister of Culture, Information, Sports and Youth Policy of the Kyrgyz Republic. The Deputy Director and other employees are appointed and dismissed by the Director.
  4. The employees of the Center, including the Director, are not public servants.
  5. The Director of the Center:
  1. Provides general management of the Center’s activities;
  2. Is personally responsible for the execution of tasks assigned to the Center;
  3. Appoints and dismisses employees, including the Chief Accountant, and imposes disciplinary measures or rewards them;
  4. Distributes the functional duties of employees;
  5. Issues orders and instructions within his or her competence, which are binding on the Center’s employees;
  6. Represents the Center in government bodies, local self-government bodies, enterprises, institutions, and organizations of the Kyrgyz Republic, as well as in international and regional organizations on issues within the Center’s competence;
  7. Nominates employees for state and other awards;
  8. Submits proposals to the President’s Administration for cooperation agreements with domestic and foreign research centers and with relevant international and regional organizations;
  9. Exercises other powers established by regulatory legal acts of the Kyrgyz Republic.
  10. The working conditions of the Center’s employees are determined by the labor legislation in force.

Chapter 7. Liquidation and Reorganization of the Center

In the event of termination of activities, the Center’s documents are stored and used in accordance with the Law of the Kyrgyz Republic “On the National Archive Fund of the Kyrgyz Republic.

The liquidation and reorganization of the Center are carried out in accordance with the legislation.

The Center’s activities are considered terminated once the relevant entry is made in the state register of legal entities.
